New Practice Direction on the Use of Artificial Intelligence in Tribunal Proceedings
Effective March 30, 2026, the Ontario Land Tribunal (OLT) is implementing a new Practice Direction on the use of artificial intelligence (AI) in OLT proceedings.
While the Tribunal does not prohibit the use of AI to assist in preparing documents, parties, participants and witnesses will be required to disclose the use of AI to create or generate content in documents filed with the Tribunal.
What is required?
If generative AI is used to create content in a document, the first paragraph of that document must include the following declaration:
Artificial intelligence (AI) was used to generate content in this document [at paragraphs x to y]. All content generated by AI, and the authenticity of all authorities cited in this document, has been reviewed and verified by [include the name of the party/representative to the proceeding].
This requirement ensures transparency and allows all parties and the Tribunal to appropriately scrutinize the accuracy of materials. It reflects best practices adopted by courts and tribunals across Canada and aligns with the Government of Ontario’s Responsible Use of Artificial Intelligence Directive.
