In accordance with Rule 11 , Where a party intends to raise a question about the constitutional validity or applicability of a matter before the Tribunal, or where the party claims a remedy under subsection 25 (1) of the Canadian Charter of Rights and Freedoms, notice of a constitutional question shall be served and filed on the other parties to the proceeding, the Attorney General of Canada and the Attorney General of Ontario with proof of service, as soon as the issues requiring notice are known and, in any event, at least 15 days before the question is argued. The notice referred to shall be in substantially the same form as required under the Rules of Civil Procedure for a notice of constitutional question.
