This appeal came on for hearing in the City of Ottawa on the 25th day of November, 1988 in the presence of C.R. McAviney, counsel for the appellant and H.R. Brodmann, counsel for the respondent and upon hearing counsel for the parties;

  1. This tribunal orders that the appeal is dismissed, without prejudice of the right of the appellant to make any further application to the respondent.
  2. This tribunal orders that the appellant shall pay to the respondent the costs of the appeal fixed at $250.
