Changes to ELTO and the Office of the Mining and Lands Commissioner

The government has announced plans to have the Office of the Mining and Lands Commissioner (OMLC), currently under the Ministry of Natural Resources and Forestry (MNRF), join the Environment and Land Tribunals Ontario cluster (ELTO) as its sixth tribunal. The OMLC would also undergo a name change, and would join ELTO as the Mining and Lands Tribunal (MLT).

These changes are proposed to come into effect on April 1, 2018.

The OMLC is an adjudicative body that primarily resolves disputes arising within the mining industry. It also hears appeals of decisions made by conservation authorities, which involve property owners who want to develop lands in floodplains, hazardous lands, dynamic beaches and wetlands.

There are no proposed changes to the powers and functions of the OMLC as it becomes the Mining and Lands Tribunal, and ELTO will work together with MLT to ensure a seamless transition.
